These Terms of Service ("Terms") govern your access to and use of FoundersFleet, operated by Eight Bit Studios, LLC ("we," "us," or "our"). By creating an account or using the platform, you agree to these Terms. If you don't agree, don't use FoundersFleet.

1. What FoundersFleet Is

FoundersFleet is a platform for early-stage founders. It provides tools to help you build and track your startup journey including a Flight Plan, Missions, Squads, a founder Directory, AI-powered analysis tools (Competitive Analysis, Economist AI, Stack Pilot), and the ability to connect and communicate with other founders.

FoundersFleet is currently invite-only. Access is granted at our discretion.

2. Your Account

You must be at least 18 years old to use FoundersFleet. You are responsible for maintaining the security of your account and for all activity that occurs under it. Use a strong password and notify us immediately at foundersfleet@eightbitstudios.com if you suspect unauthorized access.

You may not share your account credentials or allow others to access the platform through your account.

3. Acceptable Use

You agree to use FoundersFleet only for lawful purposes. You may not:

• Post or share content that is illegal, harassing, defamatory, obscene, or otherwise harmful.
• Misrepresent yourself, your startup, or your affiliation with any organization.
• Share another founder's confidential information disclosed within the platform without their permission.
• Use the platform to spam, solicit, or promote services to other members without their consent.
• Attempt to reverse-engineer, scrape, or copy any part of the platform.
• Attempt to gain unauthorized access to any account, system, or data.
• Interfere with or disrupt the platform or its infrastructure.
• Use automated tools, bots, or scripts to interact with the platform without our written consent.

4. Content You Post

You retain ownership of any content you submit to FoundersFleet — your profile, startup details, documents, and messages. By posting content, you grant Eight Bit Studios a limited, non-exclusive license to store, display, and process that content solely to operate and improve the platform.

You are solely responsible for the content you post. Don't post anything you don't have the right to share.

5. AI-Powered Features

FoundersFleet includes AI tools powered by third-party APIs including Anthropic's Claude. These features are provided as-is. AI-generated content — including competitive analyses, economic insights, and stack recommendations — is for informational purposes only and does not constitute professional legal, financial, or technical advice. Use your own judgment before acting on any AI output.

We apply fair-use limits to AI features to maintain platform health. A small number of users who exceed normal usage may be contacted directly.

6. Advisory Sessions

Advisory Sessions (Co-Pilot Sessions) are one-off 60-minute working sessions with Eight Bit Studios personnel. These sessions are for strategic and technical discussion only and do not create an ongoing advisory, employment, or agency relationship. Session fees are non-refundable unless we cancel. We reserve the right to decline or reschedule a session at any time.

7. Subscriptions and Billing

FoundersFleet is currently free during its invite-only period. When paid tiers are introduced, the following will apply:

• Subscriptions are billed in advance on a monthly or annual basis.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial refunds.
• We reserve the right to change pricing with 30 days' notice.
• Payments are processed securely via Stripe.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we believe your use poses a risk to other members or the platform. We'll make reasonable efforts to notify you in advance unless the situation requires immediate action.

You may delete your account at any time by contacting us at foundersfleet@eightbitstudios.com.

9. Intellectual Property

FoundersFleet, its design, features, and underlying code are owned by Eight Bit Studios, LLC. Nothing in these Terms transfers any ownership of the platform to you. You may not use our name, logo, or branding without our written permission.

10. Disclaimer of Warranties

FoundersFleet is provided "as is" without warranties of any kind, express or implied. We don't guarantee the platform will be error-free, uninterrupted, or that any particular outcome will result from using it. Startup building is hard — we're here to help, not to guarantee results.

11. Limitation of Liability

To the fullest extent permitted by law, Eight Bit Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FoundersFleet. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Cook County, Illinois.

13. Changes to These Terms

We may update these Terms as the platform evolves. We'll notify you of material changes by email or via the platform. Your continued use after the effective date of any changes constitutes acceptance of the revised Terms.
